Workers' compensation fraud is not a victimless crime – injured workers are burdened with a smaller benefit pool, employers must pay higher insurance rates, the local economy has fewer jobs as a result and consumers pay a hidden “fraud tax.”

The EMPLOYERS® Fraud Investigations Department operates a comprehensive Anti-Fraud Program that discourages individuals from attempting to commit fraud and pursues the criminal prosecution of those who will not be deterred.

  • All states have criminal statutes which support the criminal prosecution of workers’ compensation fraud (specific workers’ compensation fraud, general insurance fraud, theft or larceny statutes).
  • Just as cases of suspected vehicle theft and burglary should be reported to the appropriate law enforcement agency, so should cases of suspected workers’ compensation fraud.
  • In order to obtain a successful criminal prosecution, the elements of criminal fraud must be articulated in order to elevate the case above simple workers’ compensation abuse.
